1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement between you and Howdy Locksmith (“Company,” “we,” “us,” or “our”) concerning your access to and use of the https://howdylocksmith.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing or using our Site and services, you agree that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these terms, you are prohibited from using or accessing this Site and our services.

2. SERVICES PROVIDED

Howdy Locksmith provides professional locksmith services throughout Texas, United States. Our services include but are not limited to:

  • Residential locksmith services (lockouts, rekeying, lock installation and repair)
  • Commercial locksmith services (master key systems, access control, security upgrades)
  • Automotive locksmith services (car lockouts, key replacement, ignition repair)
  • 24/7 emergency locksmith services
  • Smart lock installation and configuration
  • Security system consultation and installation

We reserve the right to refuse service to anyone for any reason at any time.

3. SERVICE APPOINTMENTS AND SCHEDULING

Booking: Services may be scheduled through our website, by phone at 469-9911-557, or via email at service@howdylocksmith.com. All appointments are subject to availability.

Cancellation Policy: If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Cancellations made with less than 24 hours notice may be subject to a cancellation fee equivalent to the service call charge.

Emergency Services: For emergency lockout situations, we strive to provide prompt service. Response times may vary based on location, traffic conditions, and current service demand. Emergency services may be subject to additional fees.

No-Show Policy: If you are not present at the scheduled appointment time and we are unable to reach you, this will be considered a no-show and you may be charged a service call fee.

4. PRICING AND PAYMENT

Estimates: Price estimates provided over the phone or online are approximate and subject to change based on the actual scope of work required upon inspection. We will inform you of any price changes before proceeding with the work.

Service Call Fee: A service call fee may apply for on-site visits. This fee covers the technician’s travel time and initial assessment.

Payment: Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, credit cards, debit cards, and other payment methods as specified at the time of service.

Additional Charges: Additional charges may apply for services performed outside of regular business hours, including nights, weekends, and holidays. Emergency services may also incur additional fees.

Taxes: All prices are subject to applicable state and local taxes.

5. WARRANTY AND SERVICE GUARANTEE

We stand behind the quality of our workmanship. All services performed by Howdy Locksmith are guaranteed for a period of 90 days from the date of service, subject to the following conditions:

  • The warranty covers defects in workmanship only
  • Parts and hardware are covered by their respective manufacturer warranties
  • The warranty does not cover damage caused by misuse, abuse, attempted forced entry, or natural disasters
  • The warranty is void if unauthorized repairs or modifications are made to the locks or systems we installed
  • The warranty does not cover normal wear and tear
  • To make a warranty claim, you must contact us within the warranty period and provide proof of service

6. CUSTOMER RESPONSIBILITIES

By using our services, you agree to:

  • Provide accurate information regarding the service location and nature of the work required
  • Provide valid proof of ownership or written authorization to access the property where services are to be performed
  • Ensure a safe working environment for our technicians, free from hazards
  • Pay for all services rendered according to the agreed-upon terms
  • Be present or have an authorized representative present during service calls when required
  • Notify us immediately if there are any concerns about the service provided
  • Not use our services for any illegal purposes

7. PROOF OF OWNERSHIP AND AUTHORIZATION

For your security and ours, we require proof of ownership or authorization before providing locksmith services. This may include:

  • Valid government-issued photo identification
  • Proof of residence (utility bill, lease agreement, property deed)
  • Vehicle registration and title for automotive services
  • Written authorization from property owner or manager for commercial properties

We reserve the right to refuse service if adequate proof of ownership or authorization cannot be provided.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Howdy Locksmith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from our services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services
  • Pre-existing damage to locks, doors, windows, or vehicles that is discovered during service

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid us for the specific service in question.

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Howdy Locksmith and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms of Service
  • Your use of our services
  • Your provision of false or misleading information
  • Your violation of any rights of a third party

10. INTELLECTUAL PROPERTY RIGHTS

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Howdy Locksmith, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent.

11. PROHIBITED USES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Prohibited activities include but are not limited to:

  • Using the Site to engage in any illegal activity or solicitation of illegal activity
  • Requesting services for unauthorized entry into properties
  • Impersonating another person or entity
  • Interfering with security-related features of the Site
  • Attempting to access any portions of the Site that you are restricted from accessing
  • Using the Site to advertise or offer to sell goods and services without our express written consent
  • Harassing, annoying, intimidating, or threatening any of our employees or contractors

12. PRIVACY POLICY

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

13. DISPUTE RESOLUTION

Informal Negotiations: To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Service, you and Howdy Locksmith agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration or litigation.

Binding Arbitration: If we cannot resolve a dispute through informal negotiations, any dispute arising out of or relating to these Terms of Service or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Governing Law: These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Venue: Any legal action or proceeding arising under these Terms of Service will be brought exclusively in the courts located in Texas, and you consent to the jurisdiction of such courts.

14. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the “Last Updated” date at the top of this document.

Your continued use of our services after any such changes constitutes your acceptance of the new Terms of Service. We encourage you to review these Terms of Service periodically.

15. ENTIRE AGREEMENT

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Howdy Locksmith regarding the use of our services and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.

16. SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions.

17. WAIVER

No waiver by Howdy Locksmith of any term or condition set forth in these Terms of Service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.

18. FORCE MAJEURE

Howdy Locksmith shall not be liable for any failure to perform its obligations under these Terms of Service where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, acts of God, natural disasters, pandemic, strikes, or labor disputes.

19. ACKNOWLEDGMENT

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OUR SERVICES.
